1. Acceptance
By accessing or using factsfromupstairs.com (the “Site”) you agree to these Terms of Use. If you do not agree, please do not use the Site.
2. Who we are
Facts From Upstairs (“FFU”, “we”, “our”) is a publisher of magazine-quality travel guides operated from Canada. Editorial work is done by the FFU Editorial Team with assistance from AI tools, including the Alex AI persona.
3. Editorial nature of the Site
FFU travel guides are editorial content. We strive for accuracy, but travel conditions change continuously: visa rules, currency exchange, restaurant operating hours, safety conditions, opening times, prices. Always verify critical facts with official sources before you travel — especially visa requirements (your country’s embassy or consulate), vaccinations (Health Canada or your physician), travel advisories (Government of Canada Travel Advisories), and insurance requirements.
4. No professional advice
FFU does not provide legal, medical, financial, or immigration advice. Editorial recommendations on currency, insurance, vaccinations, visa rules, and similar topics are general in nature. Consult qualified professionals for advice tailored to your situation.
5. Use at your own risk
Travel involves inherent risks. FFU is not liable for loss, injury, illness, theft, missed connections, cancellations, or other harms arising from reliance on information published on the Site. To the maximum extent permitted by applicable law, the Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
6. Affiliate links
FFU is reader-supported. Some outbound links on the Site are affiliate links. When you click them and make a qualifying purchase, FFU may earn a commission at no additional cost to you. See our Affiliate Disclosure for the current list of partners and details on how affiliate revenue is handled. Affiliate revenue does not influence our editorial recommendations.
7. Custom Guide service
The Custom Guide service builds a tailored travel guide based on the information you submit. We aim to deliver within 24 hours of submission, but delivery times are estimates only and may vary based on demand and complexity. The Custom Guide is editorial content subject to Sections 3-5. Refunds, if applicable, are at our discretion.
8. Intellectual property
All editorial content on the Site — text, photos, illustrations, video, audio, design, and code — is © Facts From Upstairs unless otherwise credited. Unauthorized reproduction at scale is prohibited. You may quote brief excerpts (under 50 words) with clear attribution and a link back to the original guide.
FFU trademarks, logos, and brand elements may not be used without prior written permission.
9. User-submitted content
By submitting any content to the Site (including form submissions, feedback, and corrections), you grant FFU a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, and distribute that content for the purpose of operating and improving the Site. You represent that you have the right to submit the content.
10. Prohibited uses
You agree not to: scrape the Site at scale, use automated tools to circumvent access controls, attempt to compromise Site security, impersonate FFU staff or other users, post content that is illegal, defamatory, or infringing, or use the Site in any manner that violates applicable law.
11. Third-party links and services
The Site links to third-party services (booking platforms, insurance providers, eSIM marketplaces, transfer services, content APIs). FFU has no control over and is not responsible for the content, policies, or practices of these third parties. Your use of any third-party service is subject to that service’s terms.
12. Privacy
Use of the Site is also governed by our Privacy Policy.
13. Limitation of liability
To the maximum extent permitted by law, FFU’s total liability to any user for any claim relating to the Site or its content shall not exceed the greater of (a) CAD $100 or (b) the amount you have paid FFU in the 12 months preceding the claim. FFU is not liable for indirect, incidental, special, or consequential damages.
14. Changes
We may update these Terms. Material changes will be highlighted on this page. The “Last reviewed” date at the top reflects the most recent update. Continued use of the Site after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. The courts located in Toronto, Ontario have exclusive jurisdiction over any dispute, except where consumer protection laws of your jurisdiction grant you the right to bring claims locally.
